Pay-Per-Placement Terms & Conditions

This Term Sheet is incorporated into the Agreement between JobTarget and the Client identified in the Service Order to which this Term Sheet is attached, if one exists. In absence of a Service Order, this is incorporated into JobTarget’s Online Agreements and Terms of Use, as found at www.jobtarget.com/employer-agreements

Submitting Candidates

  • JobTarget is not required and does not control or verify the content, quality or accuracy of the job postings listed on the Pay-Per-Placement Service. You assume all risk, including risk of not being paid, when choosing to submit candidates for particular jobs.
  • When submitting candidates, JobTarget requires the name and email address of the candidate, which JobTarget uses among other purposes, to communicate to the candidate to get the candidate’s approval of the submission. Submitting your own email address, or that of an email inbox to which you or an affiliate has access, will result in your submission being rejected.
  • By making a submission you are representing that each candidate you submit through this service is over the age of eighteen (18) years old.
  • If your submitted candidate is hired, you will be entitled to your share of the fee if:
    • You submitted the candidate through JobTarget’s approved online candidate submission process.
    • The advertising recruiter has not received your candidate in the last six months for consideration.
    • Your candidate is hired by the advertising party.
    • Candidate is marked as hired in the JobTarget Pay-Per-Placement Service and JobTarget has confirmed the hire.
    • The candidate fulfills any guarantee period defined by the job or JobTarget.
    • JobTarget is successful collecting the fee from the corporate client employer.
  • Any candidate submitted shall have a JobTarget account created. JobTarget shall not market to the candidate, except for sending them the email to have them confirm the submission, provided, however, that if a candidate is already a JobTarget client for other purposes, or later comes to JobTarget and registers or engages JobTarget in another manner, then JobTarget shall retain full rights to serve said candidate.
  • JobTarget reserves the right to withdraw your candidate submission, at any time, for any reason, or no reason whatsoever. Though not a comprehensive list, the following may lead to your candidate submission being withdrawn:
    • Candidate was submitted without their permission or knowledge and/or asks to be withdrawn
    • Candidate is a duplicate of one already submitted for that posting
    • Any inaccurate or inappropriate information is in the resume or the Submission Notes

Premium Recruiter Status

  • Recruiters can achieve Premium status according to the guidelines and criteria outlined on JobTarget’s Pay-Per-Placement Search Jobs page or as defined by JobTarget, solely upon its discretion, which may change at anytime and for any reason, including no reason whatsoever.
  • Recruiters with Premium status will be entitled to the benefits outlined on JobTarget’s Pay-Per-Placement Search Jobs page. JobTarget reserves the right to change, add, or remove benefits at any time.
  • If early access to jobs is provided as a benefit, JobTarget does not guarantee a certain number of days of access and JobTarget does not guarantee a certain number of jobs with early access.
  • JobTarget reserves the right to take away Premium status from any recruiter, at any time, for any reason, or no reason whatsoever. Though not a comprehensive list, the following may lead to the loss of Premium Recruiter status:
    • Continual submission of candidates that are not qualified for the jobs they are submitted to.
    • Candidate was submitted without their permission or knowledge and/or asks to be withdrawn
    • Any inaccurate or inappropriate information is in the resume or the Submission Notes
  • Recruiters understand and agree that their Premium Status may be removed when their activity with the JobTarget Pay-Per-Placement Service does not meet the requirements for maintaining such status or as otherwise determined by JobTarget.

Additional Terms

  • It is strictly prohibited to contact or solicit any JobTarget Corporate Client Employer directly. All communications must go through the JobTarget Recruitment Services team.
  • It is strictly prohibited to directly solicit any company we list jobs for on JobTarget Pay-Per-Placement.
  • JobTarget may develop a reputation score and use such score any way it pleases, including to limit or eliminate its business relationship with you. By using our service, you are forfeiting any claim against JobTarget related to this.
  • JobTarget reserves the right to restrict your access or use of JobTarget’s services, solely in its own discretion, which it may change at any time.
  • JobTarget may in its discretion decide to share with you the name and /or contact information of other recruiters, partners, or employers, and to share your name and/or contact information with other recruiters, partners, or employers. You agree to use any such information you receive only in the context of this service.
  • Payment terms shall be thirty (30) days from invoice date. You will reimburse JobTarget for its costs of collection.
  • Without limiting the generality of any disclaimers in this Term Sheet or any other agreements relating to this service,JobTarget may take, in its sole discretion (but is not obligated to take) any steps to enforce any provisions herein and therein, including, without limitation, taking any steps to collect any fees beyond invoicing the responsible party.
  • JobTarget expressly prohibits the following actions while using this service:
    • Providing false or inaccurate names or contact information when signing up for an account or submitting a candidate.
    • Unresponsiveness or refusal to communicate with the JobTarget employees or affiliates.
    • Collecting resumes, jobs, candidate information, or recruiter information from Pay-Per-Placement for personal use or use outside JobTarget’s platform.
    • Reposting job information that is only meant to be visible on JobTarget Pay-Per-Placement. This includes but is not limited to; posting client information, salaries, and the notes put in the Message to Recruiter box that are meant to be shared privately with recruiters. Copying an exact job posting from within Pay-Per-Placement and publishing it elsewhere is strictly prohibited.
    • Not reviewing candidate submission and updating their statuses in a timely manner
