JobTarget Programmatic Terms & Conditions

This Term Sheet, along with JobTarget’s Internet Terms of Use and information and authorization provided by Client on JobTarget’s website to activate JobTarget’s Programmatic service, including Client’s credit card authorization, and any related Service Order constitutes the agreement between JobTarget and the Client under which JobTarget shall provide the service to Client and Client shall pay JobTarget for the service. In the event of any conflict between this Term Sheet and JobTarget’s Internet Terms of Use and/or the information and authorization provided by Client on JobTarget’s website, this Term Sheet shall control.

Services

In consideration of the payments set forth in the Service Order or on JobTarget’s website and Client's fulfillment of its obligations under this Term Sheet and the Agreement, JobTarget shall provide the following services during the term stated in the Service Order or on JobTarget’s website.

• JobTarget shall use commercially reasonable efforts to post Client's jobs onto any number of job board(s) included in the Programmatic Media Package at the time of posting. JobTarget shall determine when to post Client’s jobs, at which sites to post Client’s jobs and for how long to post Client’s jobs at such sites. JobTarget cannot guarantee that the jobs will be presented on every such site. Further, it is possible that certain posts may remain open beyond the time set by JobTarget, and it is possible that certain sites may redistribute content, including such postings, to other sites.
• General customer support related to the service.

Payments

As a general matter, because JobTarget and not the Client is controlling and paying for the posts, Client’s obligation to continue the service, and to pay JobTarget, renews automatically unless Client cancels the service pursuant to the time frames set forth below. JobTarget may offer free or discounted trials of Programmatic from time to time. If the Client posts jobs subject to such a promotion, Client’s credit card will automatically be charged on a recurring monthly basis after the promotional period ends, unless the Client cancels HERE prior to the end of the promotional period. Furthermore, even if not participating in any promotion, trial, or discount, Client’s credit card will automatically be charged on a recurring monthly basis, unless the Client cancels HERE prior to the monthly renewal date. There shall be no refunds.

Disclaimers

JobTarget shall use commercially reasonable efforts to list the jobs requested by Client on the appropriate job boards, as determined solely by JobTarget. JobTarget makes no other representations or warranties, express or implied, including without limitation any representation or warranty that any job will be posted on any particular site or remain posted for any particular period of time, or that any site may not modify the format of any posting, or that any site may not redistribute content, including any job postings, to any other site. Further, JobTarget makes no representations or warranties, express or implied with respect to the level of success, if any, this service may provide.
